(والأخذ بالشفعة) أي: أخذ المشتري بخيار الدار المبيعة بينما المشتراه لأنه لا يكون إلا في المثلث فكان دليل الإجازة والأخذ ليس بقيد لأنه يتم بمجرد الطلب، لمواء كان معه أخذ أو لا، ومحلى هذا ففي الكلام مضاف محذوف والأصل طلب الأخذ سواء كان طلب مواربة أو تقرير
