الجوهرة النيرةal-Haddadi

قَوْلُهُ: (وَإِذَا كَاتَبَ الْمَوْلَى أُمَّ وَلَدِهِ جَازَ) لِأَنَّهَا عَلَى حُكْمِ مِلْكِهِ؛ لِأَنَّ لَهُ وَطْأَهَا وَإِجَارَتَهَا فَمِلْكُ مُكَاتَبَتِهَا كَالْمُدَبَّرَةِ فَإِنْ مَاتَ الْمَوْلَى عَتَقَتْ بِالِاسْتِيلَادِ وَسَقَطَ عَنْهَا مَالُ الْكِتَابَةِ وَيُسَلَّمُ لَهَا الْأَوْلَادُ، وَالْأَكْسَابُ.
