فَإِنْ شَرَطُوا الإِحْدَاثَ فِيمَا فُتِحَ صُلْحًا عَلَى أَنَّهُ لَنَا جَازَ،

مطالب أولي النهىal-Ruhaybani

(فَإِنْ شَرَطُوا) ، أَيْ: الْكُفَّارُ (الْإِحْدَاثَ) لِبِيعَةٍ أَوْ كَنِيسَةٍ وَنَحْوِهَا (فِيمَا فُتِحَ صُلْحًا عَلَى أَنَّهُ) ، أَيْ: الْبَلَدَ الْمَفْتُوحَ صُلْحًا (لَنَا) ، وَنُقِرُّهُ مَعَهُمْ بِالْخَرَاجِ، (جَازَ) ، لِأَنَّهُ لَمْ يُفْتَحْ إلَّا عَلَى هَذَا الشَّرْطِ، فَوَجَبَ الْوَفَاءُ بِهِ.
