وَلَا يَحْصُلُ بِبِنَاءِ حَائِطٍ بَينَهُمَا وَلَا إنْ نَامَا أَوْ مَشَيَا جَمِيعًا.

مطالب أولي النهىal-Ruhaybani

(وَلَا يَحْصُلُ) تَفَرُّقٌ (بِبِنَاءِ حَائِطٍ بَيْنَهُمَا) ؛ أَيْ: الْمُتَبَايِعَانِ فِي الْمَجْلِسِ؛ (وَلَا إنْ نَامَا فِيهِ) ، أَوْ قَامَا مِنْهُ، (وَمَشَيَا جَمِيعًا) ، وَلَمْ يَتَفَرَّقَا؛ لِبَقَائِهِمَا بِأَبْدَانِهِمَا بِمَحَلِّ الْعَقْدِ.
