(وَلَوْ خَلَطَ) الْمَبِيعَ بِنَحْوِ كَيْلٍ (بِمَا لَا يَتَمَيَّزُ) ، كَزَيْتٍ بِشَيْرَجٍ، (لَمْ يَنْفَسِخْ) الْبَيْعُ، لِبَقَاءِ عَيْنِ الْمَبِيعِ (وَهُمَا) ، أَيْ: الْمُشْتَرِي وَمَالِكُ مَا اخْتَلَطَ بِهِ الْمَبِيعُ (شَرِيكَانِ) فِيهِ بِقَدْرِ مِلْكَيْهِمَا، (وَلِمُشْتَرٍ الْخِيَارُ) ، لِعَيْبِ الشَّرِكَةِ.
