(وَإِتْلَافُ مُشْتَرٍ) لِمَبِيعٍ - وَلَوْ غَيْرَ عَمْدٍ - قَبْضٌ، (وَ) وَإِتْلَافُ (مُتَّهَبٍ) لِعَيْنٍ مَوْهُوبَةٍ (بِإِذْنِ وَاهِبٍ قَبْضٌ) ؛ لِأَنَّهُ مَالُهُ وَقَدْ أَبْلَغَهُ.
