(وَ) مَنْ بَاعَ أَوْ وَهَبَ أَوْ رَهَنَ أَوْ وَقَفَ أَوْ أَقَرَّ أَوْ أَوْصَى (بِأَرْضٍ أَوْ بُسْتَانٍ) أَوْ جَعَلَهُ صَدَاقًا أَوْ عِوَضَ خُلْعٍ وَنَحْوِهِ، (دَخَلَ غِرَاسٌ وَبِنَاءٌ) فِيهَا - وَلَوْ لَمْ يَقُلْ بِحُقُوقِهَا - لِاتِّصَالِهِمَا بِهِمَا، وَكَوْنِهِمَا مِنْ حُقُوقِهَا، وَلَا يَدْخُلُ فِي بَيْعِ أَرْضٍ وَبُسْتَانٍ
