(وَلَا إثْمَ عَلَى مَنْ سُئِلَ) الْقَرْضَ (فَلَمْ يُقْرِضْ) ؛ لِأَنَّهُ لَيْسَ بِوَاجِبٍ، بَلْ مَنْدُوبٌ؛ لِمَا تَقَدَّمَ، وَلَيْسَ هُوَ مِنْ الْمَسْأَلَةِ الْمَذْمُومَةِ، لِأَنَّهُ إنَّمَا يَأْخُذُهُ بِعِوَضِهِ، فَأَشْبَهَ الشِّرَاءَ شَيْئًا فِي ذِمَّتِهِ.
