(وَيَتَّجِهُ) أَنَّهُ لَا يَصِحُّ التَّوْكِيلُ (إلَّا إنْ قَالَ) الْمُوَكِّلُ لِوَكِيلِهِ: وَكَّلْتُك فِي كُلِّ قَلِيلٍ وَكَثِيرٍ (مِنْ مَالِي) ؛ كَقَوْلِهِ: بِعْ مَالِي كُلَّهُ وَاقْبِضْ دُيُونِي كُلَّهَا؛ لِأَنَّهُ لَا يَعْرِفُ مَالَهُ وَدُيُونَهُ، فَيَقِلُّ الْغَرَرَ. وَهُوَ مُتَّجِهٌ.
