(وَ) إنْ قَالَ: (بِعْهُ لِزَيْدٍ، فَبَاعَهُ لِغَيْرِهِ؛ لَمْ يَصِحَّ) الْبَيْعُ؛ لِلْمُخَالَفَةِ؛ لِأَنَّهُ قَدْ يَقْصِدُ نَفْعَ زَيْدٍ، فَلَا تَجُوزُ مُخَالَفَتُهُ.

قَالَ فِي " الْمُغْنِي وَالشَّرْحِ ": إلَّا أَنْ يَعْلَمَ بِقَرِينَةٍ أَوْ صَرِيحٍ أَنَّهُ لَا غَرَضَ لَهُ فِي عَيْنِ الْمُشْتَرِي.
