وَيَتَّجِهُ: إلَّا مَعَ قَرِينَةٍ تَقْتَضِي تَخْصِيصَ أَحَدِهَا.

مطالب أولي النهىal-Ruhaybani

(وَيَتَّجِهُ) عَدَمُ تَخْصِيصِ الْإِجَارَةِ بِنَوْعٍ مِنْ الثَّلَاثَةِ (إلَّا مَعَ قَرِينَةٍ) تَمْنَعُ الْعُمُومَ، و (تَقْتَضِي تَخْصِيصَ أَحَدِهَا) - أَيْ الزَّرْعِ وَالْغَرْسِ وَالْبِنَاءِ - فَمَتَى وُجِدَتْ قَرِينَةٌ تَدُلُّ عَلَى أَحَدِهَا تَعَيَّنَ فِعْلُهُ، وَامْتَنَعَ مِنْ الزِّيَادَةِ عَلَيْهِ وَهَذَا الِاتِّجَاهُ مُسْتَحْسَنٌ.
