مطالب أولي النهىal-Ruhaybani

(وَإِنْ أَجَرَ) الْمَرِيضُ (نَفْسَهُ وَحَابَا الْمُسْتَأْجِرَ) وَارِثًا كَانَ أَوْ غَيْرَهُ (صَحَّ) الْعَقْدُ (مَجَّانًا) - أَيْ: مِنْ غَيْرِ رَدِّ الْمُسْتَأْجِرِ لِشَيْءٍ مِنْ الْمُدَّةِ أَوْ الْعَمَلِ؛ لِأَنَّهُ لَوْ لَمْ يُؤْجَرْ نَفْسَهُ لَمْ يَحْصُلْ لَهُمْ شَيْءٌ، بِخِلَافِ عَبِيدِهِ وَبَهَائِمِهِ.
