(وَإِنْ عَتَقَ) مَنْ اشْتَرَاهُ الْمَرِيضُ مِنْ أَقَارِبِهِ (عَلَى وَارِثِهِ) دُونَهُ؛ بِأَنْ يَكُونَ أَخًا لِابْنِ عَمِّهِ الْوَارِثِ لَهُ، فَاشْتَرَاهُ (صَحَّ) شِرَاؤُهُ (وَعَتَقَ عَلَيْهِ) - أَيْ: عَلَى أَخِيهِ - لِدُخُولِهِ فِي مِلْكِهِ بِإِرْثِهِ لَهُ مِنْ ابْن عَمِّهِ، فَلَا يَرِثُ مَعَهُ
