وعلَى شِرَائِهِ لَهَا عَبْدَ زَيدٍ فتَعَذَّرَ شِرَاؤُهُ بِقِيمَتِهِ؛ فَلَهَا قِيمَتُهُ

(وَ) يَصِحُّ أَنْ يَتَزَوَّجَهَا (عَلَى شِرَائِهِ لَهَا عَبْدَ زَيْدٍ) ، لِأَنَّهُ غَرَرٌ يَسِيرٌ، (فَ) إنْ (تَعَذَّرَ شِرَاؤُهُ بِقِيمَتِهِ؛ فَلَهَا قِيمَتُهُ) لِتَعَذُّرِ تَسْلِيمِهِ، كَمَا لَوْ كَانَ بِيَدِهِ فَاسْتَحَقَّ
