(وَلَا يَجُوزُ تَحَيُّلٌ لِإِسْقَاطِ حُكْمِ الْيَمِينِ) كَمَا لَا يَجُوزُ التَّحَيُّلُ لِإِسْقَاطِ الزَّكَاةِ وَنَحْوِهِ مِمَّا تَقَدَّمَ بِأَدِلَّتِهِ (وَلَا تَسْقُطُ) الْيَمِينُ أَيْ: حُكْمُهَا (بِهِ) أَيْ: التَّحْلِيلِ عَلَى إسْقَاطِهِ
