(وَمَنْ تَرَكَهُ) أَيْ الْإِنْفَاقَ عَلَى مُبَانَةٍ (يَظُنُّهَا حَائِلًا، فَبَانَتْ حَامِلًا، لَزِمَهُ) نَفَقَةُ (مَا مَضَى) لِتَبَيُّنِ اسْتِحْقَاقِهَا لِلنَّفَقَةِ فِيهِ، فَتَرْجِعُ عَلَيْهِ بِهَا كَالدَّيْنِ

وَظَاهِرُهُ: وَلَوْ قُلْنَا النَّفَقَةُ لِلْحَمْلِ، وَإِنَّهَا تَسْقُطُ بِمُضِيِّ الزَّمَانِ.
