(أَوْ) بِخِلَافِ قَوْلِهِ لِوَكِيلِهِ (اعْتِقْهُ) ، أَيْ: عَبْدِي فُلَانًا (لِأَنَّهُ أَسْوَدُ أَوْ لِسَوَادِهِ، فَلَا يَتَجَاوَزُهُ) بِالْعِتْقِ لِجَوَازِ الْمُنَاقَضَةِ عَلَيْهِ وَالْبَدْءِ
