(وإن ملك ما لا يبلغ نصابًا، ولا يغير الفرض، كخمس) من البقر بعد أربعين أو ثلاثين منها (فلا شيء فيها) أي: الخمس؛ لأنها وقص، وكما لو ملكهما دفعة واحدة.
