(ولو استؤجر لحفر بئر أو هدم شيء) من حائط وغيره (فوجده) أي: الركاز (فهو له) أي: لواجده (لا لمستأجره) لأنه من كسب الواجد.

قلت: فلو استأجره لطلب ركاز، فوجد غيره، فهو لواجده؛ لأنه ليس أجيرًا لطلب ما وجده.
