(لا) تسقط الجزية (إِن مات) الذِّميُّ بعد الحول (أو طرأ عليه مانعٌ من جنون ونحوه) كعمىً (فتُؤخذ من تَرِكَة ميتٍ، ومن مال حي) لأنها دين، فلم تسقط بذلك، كدين الآدمي.
