(وإن شَرَطَ) في رهن ما يُسرع إليه الفساد (أن لا يُباع، لم يصح) الشرط؛ لمنافاته مقتضى العقد (كما لو شَرَط) في الرهن (عدم النفقة على الحيوان) المرهون؛ لأنه يؤدي إلى هلاكه، فيفوت الغرض من التوثيق.
