(فإن اعترف الغائب) بما عليه (ورجع الحاضر عن إنكاره فله) أي: للحاضر (الاستيفاء منه) أي: الرجوع على الغائب بما غَرِمه عنه؛ لأنه يدَّعي عليه حقًّا يعترف له به.
