(فإن لم يكن له) أي: للممتنع (عين مال) أي: نقْد (وكان له مَتَاع، باعه) أي: باع الحاكم مَتَاعه (وأنفق منه) على حصته مع الشريك، كوفاء دَين الممتنع منه
