(وإن أخَّر) أحدُ الشريكين (حقَّه من الدَّين الحالِّ، جاز) لأنه أسقط حقه من المطالبة، فصح أن ينفرد به كالإبراء (لا) إن أخَّر (حقَّ شريكه) فلا يجوز؛ لأنه غير مأذون فيه نُطقًا ولا عُرفًا
