(إلا أن الغراس والبناء يؤخذان تبعًا للأرض) لقضائه - صلى الله عليه وسلم - "بالشُّفعةِ في كُلِّ مُشْتَرَكٍ لم يُقسَم، رَبْعَةً أو حائطًا" وهذا يدخل فيه البناء والأشجار.
