كشاف القناعal-Buhuti

(وله) أي: المحجور عليه (الأخذُ بها) أي: بالشُّفعة (إذا) بلغ و (عَقَل ورَشَد، سواء كان فيها حظٌّ، أو لا) ولو كان الولي قد صَرَّح بالعفو عنها؛ لأن المستحقَّ للشُّفعة له الأخذُ بها سواء كان له حظٌّ فيها، أو لم يكن.
