(ويُعتبر) للأخذ بالشُّفعة (ثبوتُ المِلك) للشفيع بالبينة، أو إقرار المشتري (فلا تكفي اليد) لأنها مرجِّحة فقط؛ عملًا بالظاهر، ولا تفيد الملك، كما يأتي في الدعاوى والبينات.
