(وإن تركها الولي بيده) أي: يد الصغير، أو السفيه، أو المجنون (بعد علمه) أي: الولي بها (ضمنها الولي) لأنه المضيع لها؛ لأنه يلزمه حفظ ما يتعلق به حقُّ موليه.
