(وإن اجتمعت عطيةٌ ووصيةٌ، وضاق الثلث عنهما، ولم تُجِز) الورثة (جميعهما؛ قُدِّمت العطية) لأن العطية لازمة في حق المريض، فقُدمت على الوصية، كعطية الصحة.
