(وإن ماتوا) أي: العبيد (إلا واحدًا؛ تعيَّنت الوصية فيه) لأنه لم يبقَ غيره، وقد تعذَّر تسليم الباقي. وهذا إن حمله الثلث؛ قاله في "الرعاية".
