(وإذا كان أرش الجنابة للسيِّد) بأن كانت الجناية عليه، أو على ماله، أو ورث أرشها عن المجني عليه (وعَجَّزه) سيده؛ لعجزه عن الوفاء (سَقَط عنه مال الكتابة وأرشُ الجناية) لأنه لا يجب له على قِنِّهِ مال؛ لأنه لو وجب لكان عليه.
