(وإذا شرط) المُكاتَب (في كتابته أن يوالي من شاء؛ فالشرط باطل، والولاء لمن أعتق) لقوله - صلى الله عليه وسلم - في قصة بَرِيرةَ:"فإنَّما الولاءُ لمن أعتق" متفق عليه . [
