(إلا أنه لا يعتق بإعتاقها) أي: بإعتاق السيد لأم الولد؛ لأنها عَتَقت بغير السبب الذي يتبعها فيه، ويبقى عتقه موقوفًا على موت السيد، وكذا لو أعتقه.
