(ولا يصح فسخٌ في خيار الشرط إلا بحكم حاكم) لأنه مختلف فيه (غيرَ ما يأتي في الباب بعده) أي: بعد ما ذكر مِن أنَّ مَن شرطت حرية زوجها، فبان عبدًا، فلها الفسخ بلا حاكم، كما لو عتقت تحته.
