(لا) تصح (نافلة ولو راتبة) مع ضيق الوقت (فلا تنعقد) لتحريمها، كوقت النهي، لتعين الوقت للفرض. وهكذا إذا استيقظ، وشك في طلوع الشمس، بدأ بالفريضة، نص عليه، لأن الأصل بقاء الوقت.
