(إلا أن يموت) المعجوزُ عن ذَبْحِه (بغيره) أي: بغير الجرح الذي جرحه (مثل أن يكون رأسُه في الماء، فلا يُباحُ) أكله (ولو كان الجرح مُوَحِّيًا) لحصول قتله بمبيحٍ وحاظرٍ، فيُغلَّب جانبُ الحظر (كما لو جرحه مسلمٌ ومجوسي) أو ذبحاه.
