(وما يمنع التولية ابتداءً يمنعها دوامًا، إذا طرأ ذلك عليه كفِسْقٍ أو زوال عَقْلٍ (١) ) فينعزل بذلك؛ لأن وجود العقل والعدالة ونحوها شرط في صحة الولاية، فتبطل بزواله، لفقد شرطها
