(ولو أبرأه) المدعي (من يمينه، برِئَ منها في هذه الدعوى) فقط. (فلو جَدَّدها) أي: الدعوى (وطَلب اليمين، فله ذلك) لأن حقَّه لم يسقط بالإبراء من اليمين، وهذه الدعوى غير التي أبرأَهُ من اليمين فيها.
