والدين إن يوصف بالحلول ... فالصلح لا يصح في المنقول عليه بالبعض مع التأجيل ... رجحه الجمهور بالدليل أي: إذا كان الدين حالًا وصالح عليه بالبعض مؤجلًا لم يصح الصلح، ورجحه جمهور الأصحاب وأقاموا عليه الدليل إذ الحال لا يصح تأجيله ولأنه معاوضة ببعض حقه عن بعض.
