(وَيَضْمَنُ) جِنَايَتَهَا (مَعَ سَبَبٍ كَنَخْسٍ وَتَنْفِيرٍ فَاعِلُهُ) لِوُجُودِ السَّبَبِ مِنْهُ دُونَ رَاكِبٍ وَسَائِقٍ وَقَائِدٍ.
