(وَكَذَا لَوْ وَرِثَ) زَوْجٌ حُرٌّ (زَوْجَتَهُ الْمُكَاتَبَةَ أَوْ) زَوْجَةً (غَيْرَهَا) أَوْ جُزْءًا مِنْهَا فَيَنْفَسِخُ النِّكَاحُ. لِأَنَّ مِلْكَ الْيَمِينِ أَقْوَى مِنْ النِّكَاحِ فَإِذَا طَرَأَ عَلَيْهِ أَبْطَلَهُ
