(وَتُعْتَبَرُ نِيَّةُ وَاهِبٍ) وَهُوَ الزَّوْجُ (وَ) نِيَّةُ (مَوْهُوبٍ) لَهُ عِنْدَ قَبُولٍ ; لِأَنَّهُ كِنَايَةٌ فِيهِ فَاعْتُبِرَتْ النِّيَّةُ فِيهِ كَسَائِرِ الْكِنَايَاتِ
