قَوْلُهُ: (وَقَالَ مُحَمَّدٌ لَا يَجُوزُ بَيْعُ الْعَقَارِ قَبْلَ الْقَبْضِ) اعْتِبَارًا بِالْمَنْقُولِ وَصَارَ كَالْإِجَارَةِ، وَالْإِجَارَةُ لَا تَجُوزُ قَبْلَ الْقَبْضِ إجْمَاعًا عَلَى الصَّحِيحِ.
