قَوْلُهُ: (وَإِذَا أَعَارَ الْمُرْتَهِنُ الرَّهْنَ لِلرَّاهِنِ فَقَبَضَهُ خَرَجَ مِنْ ضَمَانِهِ) لِأَنَّهُ بِاسْتِعَارَتِهِ وَقَبْضِهِ مِنْ الْمُرْتَهِنِ أَزَالَ الْقَبْضَ الْمُوجِبَ لِلضَّمَانِ.
