اللباب في شرح الكتابal-Maydani

هي: (العين) التي (يرثها رجلان) فأكثر (أو يشتريانها) أو تصل إليهما بأي سبب كان، جبريا كان أو اختياريا، كما إذا اتهب الرجلان عينا، أو ملكاها بالاستيلاء، أو اختلط مالهما من غير صنع، أو بخلطهما، خلطاً يمنع التمييز رأساً أو إلا بحرجٍ.

وحكمها أن كلا منهما أجنبي في حصة الآخر
