(قَوْلُهُ: وَلَا يَجُوزُ لِأَحَدِهِمَا أَنْ يَتَصَرَّفَ فِي نَصِيبِ الْآخَرِ إلَّا بِإِذْنِهِ وَكُلُّ وَاحِدٍ مِنْهُمَا فِي نَصِيبِ صَاحِبِهِ كَالْأَجْنَبِيِّ) لِأَنَّ تَصَرُّفَ الْإِنْسَانِ فِي مَالِ غَيْرِهِ لَا يَجُوزُ إلَّا بِإِذْنٍ أَوْ وِلَايَةٍ.
