(وَلَا يَعْتِقُ عَلَى مَالٍ) ؛ لِأَنَّهُ لَا يَمْلِكُ الْكِتَابَةَ فَالْعِتْقُ أَوْلَى لِأَنَّ الْعِتْقَ تَبَرُّعٌ وَلَا يُقْرَضُ؛ لِأَنَّهُ تَبَرُّعٌ كَالْهِبَةِ قَالَ - عَلَيْهِ السَّلَامُ - «قَرْضُ مَرَّتَيْنِ صَدَقَةُ مَرَّةٍ» .
