(اُعْتُبِرَ) لِصِحَّةِ شَهَادَتِهِ بِهِ (ذِكْرُ شُرُوطِهِ) لِلِاخْتِلَافِ فِيهَا، فَرُبَمَا اعْتَقَدَ الشَّاهِدُ صِحَّةَ مَا لَا يَصِحُّ عِنْدَ الْقَاضِي،

معونة أولي النهىIbn al-Najjar

[فصل: من شهد بعقد اعتبر ذكرُ شروطه] (فصل. ومن شهد بعقدٍ)

أي عقد كأن: (اعتُبر) لصحة شهادته به (ذكرُ شروطه) ؛ لاختلاف الناس في بعض الشروط. فربما يكون ترك فيه شرط يعتقد الشاهد صحته بدونه دون الحاكم.
