معونة أولي النهىIbn al-Najjar

(بخلاف) إتلاف (قِنّ تعين لعتق) ؛ كما لو قال: لله عليّ أن أعتق هذا العبد ثم أتلفه فإنه لا يجب صرف قيمته إذا أتلف في مثله؛ لأن القصد من العتق تكميل الأحكام. وهو حق للرقيق وقد هلك.
