(وَإِلَّا) يَمْلِكْ أَكْلَهُ كَالْكُلِّ إذَا أَهْدَاهُ (ضَمِنَهُ بِمِثْلِهِ لَحْمًا كَبَيْعِهِ وَإِتْلَافِهِ) أَيْ كَمَا لَوْ بَاعَهُ أَوْ أَتْلَفَهُ
